Drone Rental Agreement & Liability Waiver
This agreement applies to all DroneEverything.net drone rentals, including local pickup rentals and mail-out rentals. Submitting the Drone Rental Request Form, typing a legal name, signing electronically, or otherwise accepting the rental terms may be treated as agreement to these terms.
Drone Rental Agreement & Liability Waiver
Owner/Lessor: Gregg Brotman, owner of DroneEverything.net (“Owner”)
Renter/Lessee: The person submitting the Drone Rental Request Form (“Renter”)
By submitting the Drone Rental Request Form, Renter confirms that all information submitted is accurate and that Renter has read, understands, and agrees to this Drone Rental Agreement & Liability Waiver.
1) Agreement to Rental Terms
A rental is not confirmed until approved by Owner. Rental approval, rental payment, security deposit, shipping fees if applicable, and agreement to these terms are required before any drone rental kit is released, shipped, delivered, or picked up.
2) Rental Kit
The rental kit may include the drone, controller, batteries, charger, charging hub, case, propellers, cables, memory card, landing pad, and any other accessories provided with the rental.
Renter must return the complete rental kit with all included items by the agreed return date.
3) Rental Fees, Late Fees & Security Deposit
Rental fees are due before the rental kit is released, shipped, delivered, or picked up.
If the rental kit is returned late, the late fee equals the daily rental rate for that drone model for each day, or part of a day, the kit is late.
A security deposit is required before release. The security deposit may be paid by cash, Zelle, credit card, Apple Pay, Venmo, PayPal, Chime, or Cash App.
The deposit is held until the rental kit is returned, inspected, and accepted by Owner. Late fees, missing items, damage, replacement costs, shipping fees, carrier fees, or other amounts owed may be deducted from the deposit. If the amount owed exceeds the deposit, Renter remains responsible for the remaining balance.
4) Damage, Loss, Flyaway & Non-Return
Renter is responsible for the rental kit from the time it is released, shipped, delivered, or picked up until it is returned, inspected, and accepted by Owner.
If any item in the rental kit is damaged, missing, lost, stolen, water damaged, crash damaged, impact damaged, or returned in a different condition, Renter is responsible for the full replacement cost of that specific item.
If the drone flies away, is lost during flight, stolen, water damaged beyond use, crash damaged beyond use, unrecoverable, or not returned, Renter is responsible for the full replacement cost of the drone and any affected equipment.
If the complete rental kit is not returned, stolen, lost, or returned incomplete, the full security deposit may be kept by DroneEverything.net and applied toward replacement cost, unpaid rental fees, late fees, shipping fees, carrier fees, missing items, and any other amount owed.
5) Shipping & Mail-Out Rentals
For mail-out rentals, Renter is responsible for shipping both ways, including shipping from Owner to Renter and return shipping from Renter back to Owner.
Renter must return the kit using USPS, UPS, or FedEx unless Owner agrees otherwise in writing.
Proof of return shipping is required. Proof must show the kit was physically accepted and scanned by USPS, UPS, or FedEx. Printing a label does not count as proof of shipment.
Renter will not be charged extra rental days for normal carrier transit time after the kit is accepted and scanned by USPS, UPS, or FedEx, as long as the kit is shipped by the agreed return ship date and proof is provided.
Renter is responsible for late fees if the kit is not given to USPS, UPS, or FedEx by the agreed return ship date, proof is not provided, an unapproved carrier is used, or shipping is delayed because of renter error.
Owner is not responsible for carrier delays, weather delays, incorrect addresses, missed deliveries, failed delivery attempts, or delays outside Owner’s control.
6) Authorized Use & Legal Compliance
Renter agrees to comply with all FAA rules, airspace restrictions, LAANC requirements where applicable, Remote ID requirements where applicable, local laws, state laws, and safe operating practices.
Renter agrees not to operate the drone recklessly, illegally, near restricted airspace without authorization, over people or vehicles where prohibited, beyond visual line of sight where prohibited, in unsafe weather, or in any way that may cause injury, damage, loss, fines, penalties, or legal action.
7) Assumption of Risk, Release & Indemnification
Renter understands drone operation involves risk, including property damage, injury, death, fines, legal claims, aircraft loss, flyaway, battery failure, GPS issues, signal loss, pilot error, and environmental hazards.
Renter assumes all risk and full responsibility for possession, operation, storage, transportation, shipment, and use of the rental kit.
To the fullest extent permitted by Florida law, Renter releases and waives claims against Gregg Brotman, owner of DroneEverything.net, arising from or related to Renter’s possession or use of the rental kit, except to the extent caused by Gregg Brotman’s intentional misconduct or conduct that cannot legally be waived.
Renter agrees to defend, indemnify, and hold harmless Gregg Brotman, owner of DroneEverything.net, from any claims, damages, losses, fines, penalties, attorney’s fees, injury claims, property damage claims, third-party claims, government actions, or other liabilities arising from Renter’s possession, shipment, or use of the rental kit, except to the extent caused by Gregg Brotman’s intentional misconduct or conduct that cannot legally be waived.
8) No Warranties
The rental kit is provided as-is with no warranties, express or implied.
9) Return, Inspection & Deposit Release
The rental is not closed until the full rental kit is received, inspected, and accepted by Owner.
Deposit release or refund is not processed until inspection is complete.
Owner may document the rental kit before release and after return using photos, video, serial numbers, checklists, or inspection notes.
10) Electronic Agreement, Governing Law & Entire Agreement
Submission of the Drone Rental Request Form, typed legal name, digital signature, electronic acknowledgment, email approval, scanned copy, or electronic submission may be treated as acceptance of this Agreement.
This Agreement is governed by Florida law. Venue and jurisdiction shall be in Pinellas County, Florida, unless otherwise required by law.
This Agreement is the entire agreement between Owner and Renter regarding the rental kit. Changes must be in writing and signed or acknowledged by both parties. If any part is unenforceable, the rest remains in effect.
